Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Tuctac mobile application, website, and related services (collectively, the “Service”). By downloading, accessing, or using Tuctac, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of the Service

Tuctac is a travel journaling and trip-tracking application that lets you create trips, record travel steps, upload photos and videos, view routes on an interactive map, generate shareable stories and videos, and order physical keepsakes such as printed photo albums. Features may be added, changed, or removed over time.

2. Eligibility

You must be at least thirteen (13) years old to use Tuctac. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Your Account

You may use certain features without an account, and you may create an account to save and sync your content. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Please notify us promptly of any unauthorized use of your account.

4. Your Content and Ownership

You retain all ownership rights to the photos, videos, text, and other content you add to Tuctac (“Your Content”). We do not claim ownership of Your Content. By using the Service, you grant Tuctac a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of operating and improving the Service and providing features you request, such as generating videos, stories, or printed products.

Your Content remains private and is not displayed to other users unless you choose to export or share it. You are responsible for ensuring you have the rights to any content you upload and that it does not violate the rights of others or any applicable law.

5. Acceptable Use

You agree not to use the Service to upload, store, or share content that is unlawful, infringing, harmful, or that violates the rights of others. You agree not to attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its systems, and not to use the Service to transmit malware or to collect data about other users without authorization. We may suspend or terminate access for conduct that violates these Terms.

6. Purchases and Physical Products

Some features, including printed photo albums and other keepsakes, may be offered for a fee. Prices, availability, shipping, and production timelines are described at the point of purchase and may change. Where required by law, applicable refund and cancellation rights apply. Purchases made through a mobile app store are also subject to that store’s terms.

7. Intellectual Property

The Service, including its software, design, branding, logos, and content provided by Tuctac (excluding Your Content), is owned by Tuctac and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by these Terms.

8. Third-Party Services

Tuctac relies on third-party services for maps, analytics, cloud hosting, authentication, and crash reporting. Your use of those services may be subject to their own terms and privacy policies. Tuctac is not responsible for the practices or content of third-party services.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that location tracking, routes, or generated content will always be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, Tuctac and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends. Certain provisions, including ownership, disclaimers, and limitation of liability, survive termination.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this document. Your continued use of the Service after changes take effect indicates your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws principles, unless otherwise required by mandatory local law applicable to you.
